Are You A Survivor?

April 2022: The MDL Paraquat class action judge will have a status conference on April 1st to review where the litigation is headed and how best to take the bellwether lawsuits forward for trial in November 2022. 44 new paraquat lawsuits have been added to the MDL in the last two weeks. At this pace, April 2022 will be the busiest month for new files yet. Last week, the parties filed their class-action bellwether picks with the Paraquat MDL judge. Those choices, however, have not been made public.

May 2022: In the last month, over 50 new cases have been added to the Paraquat Lawsuit Multidistrict Litigation (MDL). A group of six patients was recently selected by the Paraquat MDL court for the initial Paraquat Parkinson's disease bellwether trials. As a result, the first trial in November 2022 is approaching soon. The strategy is to select 16 paraquat claims from among the almost 1000 Parkinson's disease litigation claims filed. Following some limited fact discovery in these instances, paraquat attorneys on both sides submitted a preference list to the MDL court, ranking the 16 cases in order of priority. Attorneys for plaintiffs seek the finest facts for their clients, while defense attorneys want the worst. The judge whittled the list down to six Paraquat claims based on these rankings.

Michael E. Kelly, originally from Dublin, Ireland, was ordained in 1973 and began serving in Stockton, CA. In 2007, he faced accusations of sexually abusing a boy between 1984 and 1986, leading to his temporary removal from ministry. He was reinstated in 2008 and a second accuser emerged in 2011, alleging abuse from 2000-2002. Despite this, Kelly continued in ministry. In 2012, a civil trial found him liable for child molestation. Kelly fled to Ireland in 2012 before the second phase of the trial. Additional lawsuits in 2012 accused him of further abuse, resulting in a criminal indictment and extradition warrant. Kelly is believed to be living in his native Ireland, despite federal charges for unlawful flight, and continues to hold the title of priest.

ARMY OB/GYN Investigation

Major Blaine McGraw, a U.S. Army obstetrician-gynecologist who practiced at Tripler Army Medical Center in Hawaii and later at Carl R. Darnall Army Medical Center at Fort Hood (now Fort Cavazos) in Texas, is the subject of an expanding investigation into allegations that he sexually abused and secretly recorded patients during intimate exams. He was removed from clinical duties on October 17, 2025, after a Fort Hood patient reported misconduct during a gynecological appointment. Army officials have confirmed that he is no longer treating patients and that both criminal and administrative investigations are ongoing.

The case became public when a woman identified as “Jane Doe” filed a civil lawsuit in Bell County, Texas. She alleges that in a series of appointments in 2025, McGraw performed unnecessary and invasive breast and pelvic exams and secretly recorded her with his cell phone. Following her report, the Army Criminal Investigation Division seized McGraw’s electronic devices. According to what investigators reportedly told Jane Doe and her attorneys, they uncovered images and videos involving multiple women, including recordings of her exams. Media accounts and court filings describe a large cache of images and videos spanning multiple years and involving numerous patients from both Fort Hood and Tripler. What began as a single lawsuit quickly widened as more women came forward. Attorneys representing alleged victims say that more than 45 to 55 women from Fort Hood and Tripler have contacted them with similar accounts. Many report feeling that exams were unnecessarily intimate or prolonged, that they were denied chaperones or asked to have spouses wait outside, and that they later questioned whether procedures were medically justified. Some women also suspect they may have been recorded without their consent after learning of the allegations outlined in Jane Doe’s case and the reported discovery of digital evidence.

In response to the allegations at Fort Hood, officials say that McGraw was pulled from patient care on October 17, 2025, the day the first formal complaint was received. Army CID launched its criminal investigation, and hospital leadership implemented additional measures designed to protect patients, though they have not disclosed all of those steps. Administrators reviewed appointment logs and sent notification letters to roughly 1,400 current and former patients who had seen McGraw
